Terms of Service

This Agreement is entered into by Nebula Global LLC (a limited liability company organized under the laws of the State of Colorado, USA; hereinafter "we" or "Service Provider") and all users (hereinafter "you" or "User") who use the NexIP service (hereinafter the "Service" or "Product").

This Agreement sets out the rules of use of the Service, the rights and obligations of both parties, privacy protection measures, dispute resolution mechanisms and other related matters. Before you start using the Service, please read this Agreement carefully and confirm that you have fully understood and accepted all of its terms.

Your use of the Service is deemed unconditional acceptance of this Agreement and willingness to be legally bound by it. If you do not agree with any part of this Agreement, please stop using the Service immediately.

Service Scope: We provide services including but not limited to residential proxies, static residential IPs, dynamic residential IPs, IEPL dedicated-line transit, data transmission acceleration and network security enhancement. For the specific functions and scope of the Service, please refer to the product pages on our official website or the related documentation.

Guidelines of Use: When using the Service, you must strictly comply with this Agreement, the Acceptable Use Policy (AUP) and all applicable laws and regulations. You may not use the Service to carry out any unlawful activity, including but not limited to publishing illegal content, infringing the privacy of others, conducting network attacks, sending spam, or circumventing the security measures of third-party systems.

Updates and Upgrades: In order to improve the user experience, enhance security or fix known issues, we have the right to update and upgrade the Service from time to time. Updates and upgrades may involve functional adjustments, interface optimization or performance improvements.

You must provide accurate, truthful and complete registration information, and may not deliberately conceal or provide false information. NexIP reserves the right to request Identity Verification (KYC) for orders flagged by our risk control system.

Failure to complete KYC when requested may result in account suspension. You are responsible for safeguarding your account credentials and bear all consequences arising from any disclosure of those credentials caused by you.

Use Rights: You have the right to use the Service in accordance with this Agreement and to enjoy the various functions we provide.

Legality and Compliance: You undertake to use the Service lawfully and in compliance with all applicable regulations, and shall not use the Service to engage in any unlawful activity or to infringe the legitimate rights and interests of others. You are responsible for all traffic and content transmitted through the Service.

Data Security: You are responsible for data security and privacy protection arising from your use of the Service. We recommend that you back up your data regularly and take appropriate measures to protect data security.

All services are pre-paid. We accept credit cards and cryptocurrency. All prices are denominated in US dollars and, unless otherwise stated, exclude any applicable taxes.

Refund Policy: Refunds are only available within 3 days of purchase if the service is technically unusable. No refunds for crypto payments or if ANY traffic has been consumed.

We strive for 99.9% uptime but do not guarantee uninterrupted service. We are not liable for downtime caused by ISP outages or maintenance.

We are not liable for unavailability caused by force majeure, third-party network failures, the blocking policies of target websites, or misconfiguration on your side.

You may not resell, sublicense, or redistribute our proxy services without a written Reseller Agreement.

All intellectual property rights in the Service and its associated software, documentation, trademarks, logos and website content belong to Nebula Global LLC. You may not copy, modify, reverse-engineer or otherwise exploit such materials without our prior written consent.

Service Adjustments: We have the right to change the Service according to actual conditions, including functional adjustments, price changes and adjustments to the scope of the Service. Before any such change, we will notify you through the official website, email or similar channels.

Service Suspension and Termination: We have the right to suspend or terminate the Service due to legal and regulatory requirements, technical reasons, business strategy adjustments and similar causes. Before deciding to suspend or terminate the Service, we will notify you in advance and provide you with a reasonable solution.

If you materially breach this Agreement or the Acceptable Use Policy (AUP), we may suspend or terminate your account immediately without prior notice and without refund.

To the maximum extent permitted by applicable law, the Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose and non-infringement.

To the maximum extent permitted by applicable law, our aggregate liability to you shall not exceed the fees you actually paid for the Service in the three (3) months preceding the event giving rise to the claim. We shall not be liable for any indirect, incidental, special, punitive or consequential damages, including loss of profits, loss of data or business interruption.

The formation, validity, interpretation, performance and dispute resolution of this Agreement shall be governed by the laws of the State of Colorado, United States of America, without regard to its conflict-of-laws rules.

Any dispute arising out of or in connection with this Agreement shall first be resolved through friendly negotiation. If negotiation fails, either party may bring an action in a court of competent jurisdiction located in Jefferson County, Colorado, USA, and both parties hereby consent to the personal jurisdiction of such courts.

To the extent permitted by applicable law, both parties waive any right to bring or participate in a class action or class-wide arbitration in respect of disputes under this Agreement.

Agreement Amendment: We have the right to revise this Agreement based on changes in laws and regulations, business development needs or other reasonable causes. The revised Agreement will be published on the official website or other designated channels. You should periodically review the latest version of the Agreement.

Effectiveness and Termination: This Agreement takes effect on the date you confirm your acceptance and terminates when you stop using the Service. Please note that the provisions on privacy protection, intellectual property, limitation of liability and dispute resolution survive the termination of your use of the Service.

Notification Mechanism: We may send you notices through the official website, email, in-product messages and similar channels. You should ensure that the contact information you provide is true and valid so that we can reach you in a timely manner.

Severability and Interpretation: If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect. The right to interpret this Agreement belongs to the Service Provider; in the event of any question or dispute, we will interpret and handle the matter in accordance with this Agreement and applicable laws and regulations.
